Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://espressodolce.ca website (the “Service”) operated by Ultimate Cup of Coffee Co (hereafter “We”, “Us”, “Our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Usage of Online Store

By agreeing to these Terms of Service you represent that you have attained majority in your current state or province, or that if you are a minor dependent you are making a purchase with the express consent of an entity who has attained majority in your current state or province. Products purchased from Our site may not be utilized for any purpose which may be illegal or unauthorized as defined within your jurisdiction. This includes, but is not limited to, copyright laws, personal safety, and/or commercial liability. Any breach or violation of these Terms will result in an immediate termination of Service.

General Access to the Service

We reserve the right to refuse service to anyone at any time, for any reason.

You understand that any content provided by you (not including sensitive credit card information) may be transmitted unencrypted over various networks, and is subject to changes required to properly charge, create, and fulfill an order. Credit card or payment information is always encrypted during transfer over networks and is not subject to these changes.

As part of using this service, you are required not to reproduce, sell, resell, copy, or otherwise exploit any portion of The Service, use of the Service or access to the Service, or any contact on the website through which the service is provided, without express wrote permission by us.

The headings used herein are indicated for ease of use but do not constitute a limitation on any one set of terms scope or reach as it relates to the overall agreement of using The Service.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information,
text, graphics, videos, or other material (“Content”). You are responsible for the accuracy of any information transmitted to third parties, and you may not use this information for personal gain or to imply any relationship with us, be it as an affiliate, service provider, re-seller, or another commercial partner.

While all efforts will be made to ensure that information present on our site is accurate, timely, and correct there is no implicit or explicit guarantee of accuracy in all respects, and any commercial liability contingent upon the information provided will not accrue to us, the Service provider.

Pricing and Services Modification

While all efforts will be made to accommodate the listed price, prices for products and services are subject to change at our discretion at any time and without notice. We also reserve the right to modify or discontinue the Service or any part of it without notice at any time, and will not be liable to you or any other third party for said modification or discontinuance.

Limitations of Product or Service

Products or services may be only available online through our website. These may have limited quantities or have specific return limitations depending on the category of the product or service being offered.

While we have made every effort to accurately display color or finish information as they appear on this site we cannot ensure that your device’s display of these colors will be a completely accurate match.

We have the right to limit the sale of product or service to any person, region, regime, or jurisdiction, and will exercise this right on a case by case basis. We reserve the right to limit the quantities of product or service that we offer, and description and pricing are subject to change at any time without notice at the sole discretion of us. We also reserve the right to discontinue or mark unavailable any product or service at any time. Any offers, explicit or implicit, made on this site are void where said offers are prohibited.

Billing, Account, and Shipping Information Accuracy

It is the responsibility of you, the user of The Service, to provide as complete and accurate information as possible when making use of this Service. We will not be held responsible for mis-shipment, mis-billing, or any other consequence of information entered by the user that is inaccurate, incomplete, or falsified. We reserve the right to change or cancel orders that, in our judgment, appear to be placed in bad faith using fraudulent information, or orders attempting to circumvent the regional distribution networks of our suppliers. These restrictions can apply to personal, commercial, or wholesale businesses and will be judged solely by our criteria.

Product Returns

** All purchases made through pay bright are subject to a 20% re-stocking fee **

Before returning any orders, please fill out our Product Returns Form for a Return Authorization. We will not accept machines returned without authorization. All shipping costs are the responsibility of the customer.

Machines are generally tested by the manufacturer before shipping, so if you find grounds or bean remnants in your machine this is not indicative of a problem with the machine or that you are receiving a used machine.

A full refund can only be issued for unused machines and merchandise. We may deduct the original shipping costs, even in cases where the item was shipped as “Free Shipping”. This shipping cost can be obtained from us by request before shipping your return. We reserve the right to withhold a 20% restocking fee if machines are returned due to delivery refusal, the machine has seen more than minor use, or the machine is returned with no notification regardless of any actual issue with the machine or if the item is missing its original packaging/contents.

Returns must be initiated within 5 days of receipt of the machine. We will attempt to diagnose any issues initially with you over the phone, and we require a good faith effort on your part to perform said diagnosis. If the phone method fails we will ask you to ship the machine to one of our service centers.

Return shipments may use any reputable shipping company, but must be shipped in your name to allow you to file a claim for any damage sustained during shipping. Since you are liable for the return shipment, we strongly suggest obtaining insurance for the full value of your return package.

When returning, pack items securely and tightly seal the package. Attach Waybills in a prominent location on the exterior of the package, and remove previous shipping labels. Retain a copy of your shipping receipt and tracking number, as this information will be required in case of any mishap that occurs during shipping. Use the original packaging for the machine whenever possible, and ensure it is absolutely clean and contains no water or other liquids.

Upon receipt, the returned package contents will be examined to ensure all original items are included. The machine is then tested for possible flaws and a repair plan is created. The customer will be informed, and asked permission, to continue with repair plans at every step.

The eventual outcome of the return (repair, warranty replacement, factory replacement) cannot be determined until the machine is present in our service environment and has been examined, and no guarantees as to that outcome can be made beforehand. While we are a major service center that has partnerships with the majority of coffee machine manufacturers in Canada, we cannot guarantee their response to warranty and service claims.

Product Warranties

All espresso/coffee machines sold in a new condition will have at least a 1-year parts and labor warranty. In some cases that are provided by the manufacturer directly, and in cases where it is not, EspressoDolce provides our warranty. In either case, this warranty applies to traditional manufacturing defects or initial configuration issues. Products that have been misused, modified, misconfigured, or otherwise damaged by the end-user may not be covered by warranty depending on the extent of damage and the cause. In case of manufacturer warranty, please refer to included warranty information with your order, which can also be requested of us before you purchase.

Items not allowed for return

Consumable items including coffee beans, syrups, flavoring, pods, tea bags, opened or partially used descaler powders/liquids/tablets, used filters, pumps, replacement parts, crockery, and cutlery, cannot be returned due to either food safety laws or diminished utility.

Currency

All prices and transactions presented on EspressoDolce.ca are in the Canadian Dollar ($CAD). Transactions made in foreign currencies will be applied at ‘spot’ pricing for that day, and returns and reimbursements will have the requisite service fee applied by our merchant processor, and be deducted from the return amount.

Shipping Issues, Lost or Damaged Parcels

EspressoDolce will use the most expedient and safe shipping method possible when fulfilling your order, which can include (but is not limited to) Canada Post, UPS, CANPAR, DHL, TNT, or other freight providers. We will process all orders as soon as possible depending on stock availability and may ship from an alternate fulfillment center to ensure speedy delivery. Note that for remote locations that are the out-of-delivery area we may have to assess an additional delivery fee.

Commercial equipment above 60kg in weight or above $3500 in value will have an additional shipping fee assessed of $200 + Relevant Tax. This fee is required for the additional expense of LTL shipment, potential liftgate/palletization fees, and additional insurance to protect the shipment.
